Reports to: CC coordinator, Legal Activity Coordinator and Protection officer
Status: National Consultant
Coordinates with: Protection Monitors, Social Workers

Its activities are based on the principles of solidarity, justice, human dignity, equality of rights and opportunities, and respect for diversity and coexistence, paying special attention to the most vulnerable and unprotected people.

Project objectives: 

INTERSOS is implementing a multi-sector project funded by BHA in Taiz governorate, aimed to improve the protective environment, while reducing morbidity and mortality related to poor access to health, nutrition and WASH services in Yemen, by ensuring conflict and displacement affected individuals have access to quality emergency health and nutrition services, lifesaving protection assistance and quality WASH services.

Purpose /Objectives:

The Lawyer is responsible for the legal assistance to beneficiaries, including provision of civil documentation, legal counseling, mediation and representation. He/She is also in charge to conduct legal awareness and information sessions.

Duties:

Individual legal support:

  • Receives internal referrals from INTERSOS social workers of identified people in need of legal assistance
  • Conducts interviews with cases referred by social workers to assess legal needs, either at the INTERSOS CC or within the IDPs sites.
  • Provide individual and/or family legal counseling to beneficiaries, in order to orient them and make them aware about the legal processes available and most suitable procedures for each case.
  • Provide legal counseling to beneficiaries in need of legal protection or other legal support. This service may include only legal advice, but in discussion with the beneficiary, can also include legal representation at court, or mediation between parties.
  • Assists and counsel the beneficiaries in accessing civil documentation for HHs members, with focus on IDPs – focus on IDs and birth certificates.
  • Always maintain confidentiality and conduct all interviews and assessments, avoiding exposing beneficiaries to any harm
  • Ensure to have informed consent of the case/client, explaining clearly and transparently to the beneficiaries their legal rights and duties, and the possible outcomes/ consequences of the legal procedures.
  • Advise safety procedures/ ways to avoid further harm to the case

Legal awareness:

  • The lawyer will carry out awareness sessions on documentation and legal issues, which are identified through a community-based approach and are relevant for IDPs, Returnees and vulnerable HC members.

Meetings:

  • The Lawyer will attend case management meetings held by the case management supervisor and social outreach workers 
  • Attend ad hoc meetings, which can be called to discuss highly urgent cases.
  • Meeting with department of justice, police or any relevant authority, regarding the case based on the need and the specific situation (report back to CC coordinator and protection officer on all such meetings).

Reporting:

  • With consent of the beneficiaries involved and respect of confidentiality, provide detailed records of the beneficiaries supported, by recording information on individual case files 
  • Provide weekly and monthly overview of the support/services provided and cases assisted, included tracking case closure and civil documentation issues for beneficiaries 
  • The lawyer provides monthly reports, including figures on legal assistance to individual cases, legal awareness session and overall trends related to the legal-juridical sector.
  • Any other task requested in order to achieve the project’s objectives.
  • Always ensure confidentiality and conduct all activities respectfully and sensitively to beneficiaries and staff.

Overall, these tasks require:

  • Adherence to Humanitarian principles of Neutrality, Impartiality, Independence, and Humanity
  • Clear & timely communications to line management 
  • Full abiding by INTERSOS internal rules and guidelines and respect INTERSOS Charter of Value and Code of Ethics

Studies & professional experience:

  • Hold an advanced degree in law 
  • At least 2 years of professional practical experience working as lawyer in Yemen (registered at bar)
  • Experience in issuance of civil documentation, legal representation and legal mediation
  • Clinical legal experience is desirable.
  • Desirable familiarity with NGOs and protection principles. 
  • Demonstrable experience in establishing and maintaining collaborative relationships with government counterparts & juridical entities

Other requirements:

  • Native Arabic - basic written and spoken English
